Terms & Conditions




1.    Information on how to enter this Promotion and the Personalised Ribbon details form part of these Terms and Conditions of participation (Terms).  These Terms apply to the Promotion and participation in the Promotion is deemed acceptance of these Terms.

2.    The promoter is Lindt & Sprungli (Australia) Pty Ltd (ABN 43 079 224 892) 16 Hollinsworth Road, Marsden Park, NSW, 2765, Australia (Promoter).

3.    Participation in this Promotion is open to Australian residents (Eligible Claimants). Eligible Claimants aged under 18 must have consent from their parent or guardian to participate in the Promotion. 

4.    Where an Eligible Claimant is under the age of 18 years, the Promoter may contact the Eligible Claimant's parent / guardian via the contact details provided at Store Redemption to obtain:

a)    the parent / guardian's agreement and consent to their child / ward participating in the Promotion and the parent / guardian's agreement to the Terms on their child / ward's behalf;

b)    a warranty from the parent / guardian that their child / ward has the capacity to agree to the Terms including providing the consent contained therein; and

c)      an agreement from the parent / guardian to indemnify the Promoter for any claim arising from their child / ward's participation in the Promotion or their child / ward's non-compliance with the Terms.

5.    Employees, directors, management and contractors of the Promoter and other agencies, firms or companies associated with the Promotion (including suppliers of Personalised Ribbons), and their immediate families, are not eligible to enter.  By entering this Promotion you represent that you are eligible to enter.

6.    To submit a valid claim, claimants must:

(a)      purchase at least one (1) x 200g or 100g LINDT GOLD BUNNY (Milk, Dark, Hazelnut or White) from a participating Coles supermarket in Sydney, NSW, Melbourne, VIC, Brisbane, QLD, Perth, WA, Tasmania, TAS or Adelaide, SA between 13th April 9.30am – 5.00pm, 17th April 11.00am – 6.00pm and 18th April 10.30am – 8.30pm 2019.            Coles CBD stores including World Square, NSW and Melbourne Central, VIC will operate between 16th April (11am – 6pm), 17th April (11am – 6.30pm) and 18th April (10.30am – 8.30pm). (Qualifying Purchase); and

(b)     retain their purchase receipt and submit a Store Redemption (in accordance with these Terms). 

7.    Only one (1) Store Redemption can be submitted per Qualifying Purchase.  If an Eligible Claimant makes multiple Qualifying Purchases, separate Store Redemptions will be required, in accordance with and subject to these Terms. 

8.    Personalised ribbons will state "[Name]'s GOLD BUNNY" (Personalised Ribbon), up to a maximum of ten (10) characters per name.  For example, if the Qualifying Purchase is for three (3) LINDT GOLD BUNNY Products, the Eligible Claimant will be able to redeem three (3) Personalised Ribbons, each with different names. 

9.    Any names which, the Promoter deems, in its absolute discretion, to be inappropriate, offensive or otherwise invalid for any reason will be rejected and the Eligible Claimant will be asked to submit an alternative, valid name. 

10.  Each Store Redemption (comprising up to four (4) Personalised Ribbons) valued at up to $1.44 (incl. GST) each. Each personalised ribbon is valued at $0.36.

11.  The total Personalised Ribbons available during the Promotion is up to 61,000 during the Store Promotion Period. Total offer valued at up to $21,960 (incl.GST). 

12.  Eligible Claimants can submit no more than two (2) Store Redemptions per 24 hours during the Store Promotion Period.


13.  Pop up store redemption is only available at selected Coles Supermarkets locations including in Sydney, NSW, Melbourne, VIC, Brisbane, QLD, Perth, WA, Tasmania, TAS, Adelaide, SA.                                                                                                             Coles World Square, NSW and Coles Melbourne Central, VIC will run from 16th April (11.00am – 6.00pm), 17th April (11.00am – 6.30pm) and 18th April 2019 (10.30am – 8.30pm) or once 61,000 personalised ribbons have been awarded in accordance with these Terms in total across all stores, whichever is earlier (Store Promotion Period).                                                                                        All other selected Coles stores will run on the 13th April (9.30am – 5.00pm), 17th April (11am – 6.00pm) and 18th April 2019 (10.30am – 8.30pm) or once 61,000 personalised ribbons have been awarded in accordance with these Terms in total across all stores, whichever is earlier (Store Promotion Period). 

14.  Store redemption will be available in NSW, QLD, VIC, WA, TAS and SA only.  For exact locations and hours of pop up stores see www.lindt.com.au. Opening hours of pop up stores will be restricted to the opening hours of the Coles Supermarkets in which they operate.

15.  To redeem the offer during the Store Promotion Period and claim Personalised Ribbons, Eligible Claimants must:

                                          i.    make a Qualifying Purchase and retain the purchase receipt;

                                         ii.    visit one of the specified pop up store locations; and be one of the first Eligible Claimants to present a copy of the Coles purchase receipt at the pop up store locations for the Qualifying Purchase and personalised name/s requested, while stocks of Personalised Ribbons are available in store (Store Redemption).

16.  Each Store Redemption received during the Store Promotion Period will receive up to four (4) Personalised Ribbons each, according to the number of eligible LINDT GOLD BUNNY products purchased in the Qualifying Purchase. The maximum number of Personalised Ribbons to be claimed during the Store Promotion Period is 61,000. 

17.  The Store Promotion Period will end 8.30pm on 18th April 2019 or once all 61,000 Personalised Ribbons are awarded (whichever is first to occur).

18.  Successful Eligible Claimants will be notified immediately, in person, at the time of submitting a valid Store Redemption. 

19.  Successful Eligible Claimants' Personalised Ribbons will be printed at the time of submitting a valid Store Redemption, subject to processing and wait times, to be advised on the date of redemption.

20.  Printing times for Personalised Ribbons will vary according to demand.  The Promoter will not be liable for any delay associated with redeeming the offer during the Store Promotion Period. 



22.  The "General" Terms in paragraphs 22 to 37 of these Terms apply to the Store Promotion Period. 

23.  Eligible Claimants can only participate in the Promotion in their own name. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

24.  The Promoter accepts no responsibility for any Store Redemptions not received for any reason. Store Redemptions will be deemed to be accepted at the time of receipt by the Promoter. No responsibility will be taken for lost, late or misdirected redemptions.  The Promoter is not responsible for technical difficulties with the redemption mechanisms and does not warrant that the redemption mechanisms will be available at all times. 

25.  Incomplete, illegible, indecipherable or incorrect redemptions, or redemptions containing offensive or defamatory comments, or which breach any law or infringe any third party rights (including intellectual property rights) are invalid.  Any claimant who, in the opinion of the Promoter, tampers or interferes with the redemption mechanisms in any way, or who does not properly comply with the redemption process, will be ineligible to redeem the Personalised Ribbons. 

26.  The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

27.  The Promoter accepts no responsibility for any variation in the value of Personalised Ribbon/s, or for any tax liabilities that may arise from participating in the Promotion.

28.  Personalised Ribbons are not transferable and cannot be exchanged as cash or any other item. 

29.  The Promoter’s decision is final on all matters and no correspondence will be entered into.

30.  All entries become the property of the Promoter.

31.  If for any reason a claimant does not take a personalised ribbon by the time stipulated by the Promoter, then they will forfeit their right to this gift.

32.  The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, suppliers and, as required, to Australian regulatory authorities.  Participation is conditional on providing this information.  By participating, Eligible Claimants consent to the Promoter, until such a time as they withdraw their consent by giving notice to the Promoter, using the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant.  Eligible Claimants should direct any request to access, update or correct information by contacting the Promoter on 02 9854 2500 or via email to consumerservice@lindt.com.au.  The personal information collected in connection with this Promotion will be used, stored and disclosed in accordance with the Promoter’s Privacy Policy, available at http://www.lindt.com.au/swf/eng/privacy-policy/. The Privacy Policy contains information about how claimants may opt out, access, update or correct their personal information, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose claimant’s personal information to any entity outside of Australia.

33.  If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

34.  Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

35.  The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with this Promotion or as a result of accepting or using the Personalised Ribbons, except for any liability which cannot be excluded by law.
